What are their options?
Unfortunately, the Evans family doesn't have much leeway when it comes to taking legal action against The Holiday Place. If they want to take the travel agency to arbitration, they'll need to show that they exhausted all other options for solving the problem on their own. It would take effort and resources (both time and money) to gather all the data required. Despite how unfortunate it is, they might have to take this experience as a lesson learned.
Food poisoning and wasps
That doesn't mean, though, that guests never receive compensation for terrible stays. More than $130,000 was paid out in compensation to visitors of an all-inclusive five-star Turkish resort in 2016 by a British travel operator. Many guests, citing a “food poisoning pandemic” and a wasp infestation as their reasons for hiring a travel law firm, received compensation. Their sense of vindication was small, but it helped offset the disappointment they felt.
